I am attempting to identify how long and employee who is out on STD and now transitioning to LTD has to stay as an employee. She has specifically told us that she has no intention of returning to work due to her sever health condition She went out on disability in January of this year. I believe it is time to send her a notice that we can no longer retain her position and that her employment with the company has ended and we welcolme her the opportunity to apply in the the future.
The question is what is the time frame that we have to legally hold her job before we terminate her.
