I have an employee that has used up all of his vacation/sick and floating holidays plus more than allotted. He has called in with various excuses following PTO this entire week. We have decided to fire him but this morning I received an email from him stating that he is going through an emotional time and needs to take more time off. Can I still fire him without suffering any legal recourse from him?
