I referred someone to my company for employment and they have made her an offer. She has to give consent for a criminal background check, and just told me of an incident that happened several months ago...her 17 yr old daughter put a couple of articles of make up in a shopping cart in the market,unbeknownst to the woman, and left the store. they were stopped outside, and the woman did not want her young daughter to take the brunt of the scene, so she took responsibility for the event. fast foward to this job opportunity, she went to court, pled guilty and paid a fine. When she recently questioned a police officer she was told that this "e;incident"e; would appear on the record.otherwise it will be clean. will there be any flexibility in the policies on whether, based on circumstances, the woman may still be eligible for hire? Is it cut and dried"e;any criminal activity, no job"e; or are these policies set by individual companies or are there laws governing what can take place? This woamn is devastated at the thought of losing out on this position. She has not consented to the background check yet. please advise.
