Can an employee withdraw a harassment complaint? The employee has Bipolar Disorder and ADHD and has had behavioral problems. However, no documentation was kept by management on these problems. Would the employee have to hand in evidence in order to support the validity of the prior claim? The employee was claiming a hostile work environment was created by coworkers talking about her possible sexual orientation because a former coworker may be filing suit against her. By admitting the possible lawsuit, can the company terminate the employee for sexual harassment?
