Abuse of non exempt salary employee My brother recently started a new job. The agreed upon salary was $42,000. He was hired over the phone on Thursday night and was told they may need him to fly out to Cleveland on Sunday (He lives in Tucson, AZ). Then when he is filling out paperwork at their office on Friday the tell him instead he has to drive one of their vans to Chicago, Ill,be there by noon on Monday and then fly to Cleveland. It's a 30 hour drive to Cleveland and he has two and 1/2 days to do it, which requires at least 12 hours of driving a day. Flys to Cleveland on Monday. Works Tuesday 8-6, Wednesday 8-8, so he is already up to 52 hours in 5 days and they expect him to work the next two days at at least 10 hours a day. So thats 72 hours in 7 days. Can a non-exempt salary employee be required to do that? How many consecutive days can they work him without a day off? They are also giving him $25 a day per diam, but only after he shows receipts of at least $25 for food (if the reciepts total more it's on him to pay the differnece). Times are tough and my brother has been out of work for some time, but I think this company is taking advantage of this and him.
