We are located in Texas - call center, sales based environment. We have 1 employee who misses work frequently due to allergy related issues. She is now stating that her Dr says something at home or work is triggering these bouts of illness. She is asking for us to allow her to work from home. Our policy is that employees only work from home in inclement weather. We have the ability for her to work from home, but do not want any employee doing this full time do to bad experiences in the past - not working, dropping calls, logging in but not being available, etc. Are we able to deny her request? Are we legally able to request supporting documentation of what she is claiming? Help! In all honesty - this particular employee pushes the limits of all rules - tests what they can get away with at every opportunity. Although they are a a top producer, they stress caused by them impacts entire floor. Our concern is that allowing them to wk from home will only breed further discontent among our consistant, reliable producers that are no longer allowed to wk from home.
