We have an employee who hurt himself, suffered a hernia, but it was not job related. His injury appears to be affecting his work performance, however. He is a roofer. He has a note from a physician clearing him for all duty. Our fear is that the physical demands of his job will cause the injury to worsen, and we will then be liable for a worker's comp claim. Is there anyway that we can make him get the surgery for his injury before allowing him to work anymore? More than even worrying about the worker's comp claim, we are truly concerned for his own physical welfare.
